CopWare Terms of Service
Effective Date: August 19, 2026
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of CopWare Products, including CPOLS, related applications, and online services provided by CopWare, Inc. (“CopWare,” “we,” “us,” or “our”).
By accessing or using CopWare Products, you agree to these Terms. If you do not agree, do not use CopWare Products.
2. Relationship to Site License Agreement
If your agency has a Site License Agreement with CopWare, that agreement governs the agency’s subscription and commercial relationship with CopWare. These Terms supplement the Site License Agreement and govern your individual use of CopWare Products as an Authorized User.
In the event of a conflict between these Terms and an applicable Site License Agreement (including any addenda), the Site License Agreement controls.
3. Eligibility
CopWare Products are available to:
- Authorized Users under an agency Site License Agreement
- Individual subscribers with valid subscriptions
You represent that you have the authority to agree to these Terms on behalf of yourself and, if applicable, your agency.
4. Your Account
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying CopWare promptly of any unauthorized access
You may not share your account credentials or allow others to access CopWare Products using your account.
5. Acceptable Use
You agree to use CopWare Products only for lawful purposes and in accordance with these Terms. You may not:
- Redistribute, sublicense, or provide access to CopWare Products to unauthorized third parties
- Reverse engineer, decompile, or disassemble any software
- Scrape, crawl, or systematically extract content
- Use CopWare Products for any commercial purpose outside the scope of your license
- Attempt to circumvent security measures or access controls
- Use CopWare Products in any manner that could damage, disable, or impair our services
6. Intellectual Property
CopWare retains all right, title, and interest in and to CopWare Products, including all associated intellectual property rights. Your use of CopWare Products does not grant you any ownership rights.
CPOLS content is provided under authorization from the California Department of Justice. California statutory codes are reproduced for reference purposes.
7. Content and Accuracy
CopWare Products provide legal reference content for informational purposes only. CopWare does not provide legal advice.
Content is provided “as is” without warranties of accuracy, completeness, or fitness for a particular purpose. You are responsible for how you use CopWare Products in operational or legal decision-making.
8. Service Availability
We strive to maintain reliable access to CopWare Products but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features with or without notice.
9. Privacy and Data Security
Our collection and use of information is governed by our Privacy Policy, available at copware.com. By using CopWare Products, you consent to our data practices as described in the Privacy Policy.
CopWare maintains reasonable administrative, technical, and physical safeguards designed to protect account information. Account and usage data is stored and processed in the United States. CopWare does not sell, rent, or disclose individual user data for marketing or advertising purposes.
10. Disclaimer of Warranties
COPWARE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COPWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF COPWARE PRODUCTS.
COPWARE’S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU OR YOUR AGENCY DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Termination
We may suspend or terminate your access to CopWare Products if you violate these Terms or if your agency’s Site License Agreement terminates.
Upon termination, your right to access CopWare Products ceases immediately.
13. Changes to Terms
We may update these Terms from time to time. Updated Terms will be posted at copware.com with a revised effective date. For material changes, we will make reasonable efforts to provide additional notice, such as by email or in-app notice. Continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of California. Any dispute shall be resolved in the state or federal courts located in California.
15. Severability
If any provision is held unenforceable, the remaining provisions remain in full force and effect.
16. Entire Agreement
These Terms, together with any applicable Site License Agreement, End User License Agreement, and Privacy Policy, constitute the entire agreement between you and CopWare regarding your use of CopWare Products.
